GREETINGS:

WHEREAS, the Supreme Court, on September 5, 2006, adopted a resolution in the above-entitled case, to wit:

"G.R. No. 170495 (Fe L. Sun, et al. vs. Mayor Oriculo A. Granada, as Municipal Mayor of Guindulman, Bohol, et al.)

Acting on the Motion for Reconsideration of the resolution of June 27, 2006, dated July 20, 2006 filed by counsel for petitioners, the Court Resolved to

(a) GRANT the Motion for Reconsideration;

(b) RECALL the resolution of June 27, 2006 denying the petition and lifting the temporary restraining order issued on December 13, 2005;

(c) REINSTATE the petition; and

(d) RE-ISSUE the aforementioned temporary restraining order, effective immediately and continuing until further orders from this Court, enjoining the respondents from enforcing and implementing Municipal Ordinance No. 2003-07 of the Sangguniang Bayan of Guindulman, Bohol.

The Court further Resolved to

(a) NOTE and ACCEPT the Letter-Explanation dated August 9, 2006 of the lawyers of the Agenda Division of the Office of the Clerk of Court En Banc relative to the resolutions of June 13, 2006 and June 27, 2006; and

(b) NOTE the

(i) Motion for Clarification dated July 28, 2006 filed by the Provincial Legal Office of Bohol, counsel for respondents, relative to the second paragraph of the resolution of June 13, 2006; and

(ii) Supplemental Motion for Reconsideration with Motion for Clarification of Two (2) Contrasting Orders, dated July 31, 2006 filed by counsel for petitioners relative to the resolutions of June 13, 2006 and June 27, 2006."

NOW, THEREFORE, effective immediately and continuing until further orders from this Court, You, Respondents Mayor Oriculo A. Granada and Sangguniang Bayan of Guindulman, Bohol, your agents, representatives, or persons acting in your place or stead, are hereby ENJOINED from enforcing and implementing Municipal Ordinance No. 2003-07.
