G.R. No. 162207 (Civil Service Commission vs. Leodegario B. Valera, Jr.)

The Court Resolved to NOTE the Reply (to the comment of the respondent), dated 21 December 2004 filed by the Office of the Solicitor General for the petitioner in compliance with the resolution of 19 October 2004.

Acting on the petition, the Court Resolved to DISMISS the petition for failure thereof to sufficiently show that any grave abuse of discretion was committed by the Court of Appeals in rendering the challenged decision and resolution dated 25 July 2003 and 12 February 2004, respectively, which, on the contrary, appears to be in accord with the facts and the applicable law and jurisprudence.
